Please read these Terms of Service carefully before using Playlist Jungle. By registering or using the platform, you agree to these terms.

§ 1 Provider and Scope

These Terms of Service ("Terms") govern the use of the Playlist Jungle platform ("platform" or "service"), operated by the sole proprietorship Paul Roggenbuck, Seesener Straße 73, 10709 Berlin, Germany ("Playlist Jungle", "we", or "us").

These Terms apply to all users of the platform, regardless of whether they use it as an artist, curator, or otherwise.

Any deviating, conflicting, or additional terms of the user shall not become part of the contract, even if we do not expressly object to them.

§ 2 Service Description

Playlist Jungle is a digital platform that enables independent musicians (artists) to submit songs to playlist curators. Curators review submitted songs and decide at their own discretion whether to include them in their Spotify playlists.

The platform provides the following core features:

  • For artists: song submission via a credit system; structured feedback in six categories; if accepted, an intended 30-day playlist placement from successful addition; option to commission a new review for a possible extension (§ 8).
  • For curators: management of Spotify playlists via the platform; review and rating of submitted songs; structured feedback system; communication with artists.
  • Playlist Jungle is not a music publisher, agency, or music rights distributor. We solely facilitate contact between artists and curators.

§ 3 Registration and Account

Use of the platform requires registration. Registration is available to natural persons aged 18 and over, as well as companies and other legal entities.

You must provide complete and truthful information upon registration and keep it up to date.

Only one account per person or company is permitted. Creating duplicate or fake accounts is prohibited.

You are solely responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized use of your account.

Curator access requires a separate application and explicit approval from Playlist Jungle.

§ 4 Contract Formation

A usage agreement for the free basic features of the platform is formed upon completion of registration.

For paid features (in particular the purchase of submission credits under § 7 and playlist extensions under § 8), the purchase contract is formed upon payment confirmation by the payment processor Stripe. An order confirmation will be sent by email.

§ 5 Services for Artists

Registered artists can submit songs to individual playlists through the platform. Each selected playlist constitutes a separate submission and costs one (1) submission credit (§ 7), even where the same curator manages multiple selected playlists. This is disclosed before submission.

Curators evaluate submitted songs and provide structured feedback in six categories: Mix/Mastering, Song Structure, Originality, Vocals/Performance, Melody/Harmony, and Playlist Fit. For multiple submissions of the same song to the same curator, general song feedback and the five general rating values may be reused and adjusted. Playlist fit, fit explanation, and decision must be completed individually for every playlist. There is no entitlement to acceptance or a specific rating.

There is no entitlement to acceptance. If a song is accepted, Playlist Jungle generally plans a 30-day placement from successful addition. Technical outages, Spotify actions, or deletion of a playlist may affect the actual duration. No specific streams or reach are promised.

After the placement period, the song is automatically removed from the playlist. An extension is possible under the conditions of § 8.

§ 6 Services for Curators

Curators gain access to a submission queue and may review, accept, or decline submitted songs.

Submissions are displayed to curators as non-binding individual review offers. Curators may allow any offer to expire without giving reasons and without adverse consequences. If a curator processes an offer within 50 hours, it is deemed accepted.

Compensation is paid solely for a complete editorial review finished within the offer period and is independent of whether the song is accepted or declined. There is no obligation to accept any particular song.

Ratings must be objective, honest, and non-discriminatory, and must reflect the actual reasons for the decision. Where the same song is reviewed for multiple playlists managed by the same curator, the fit explanation must be individual to each playlist.

Curators are responsible for maintaining the necessary access and permissions for their managed Spotify playlists.

The separate provisions of § 8 apply to extension requests.

§ 7 Submission Credits

7.1 Nature of Credits. Submission credits are virtual units that entitle you solely to use the submission feature on Playlist Jungle. They do not constitute monetary value, e-money, or a payment claim against Playlist Jungle. Credits are non-transferable and cannot be exchanged for money.

7.2 Purchase. Submission credits can be purchased in packs via the payment processor Stripe. Current packs and prices are listed on the platform's billing page.

7.3 Validity. Paid submission credits purchased after this version takes effect remain valid through 31 December of the third calendar year following purchase. The specific expiry date is displayed before purchase and in the user account. Credits purchased earlier for which no expiry date is shown in the user account remain valid indefinitely. If Playlist Jungle discontinues the platform or terminates the agreement without good cause attributable to the user, the demonstrably paid remaining value of unused credits will be refunded pro rata.

7.4 Right of Withdrawal. Consumers have the statutory right of withdrawal. If a consumer requests use of a credit during the withdrawal period and later withdraws, proportionate compensation may be payable for submission services already fully performed. See the withdrawal policy for details.

7.5 Non-Transferable. Credits cannot be transferred to other user accounts or redeemed for cash.

7.6 Free Starter Credit. New users receive one free submission credit after adding a payment method. This credit is non-refundable.

7.7 Credit Cap. A user account may hold no more than nine unused submission credits at the same time. Another purchase is possible once sufficient capacity is available after existing credits have been used.

§ 8 Playlist Extension

8.1 After a song is automatically removed from a playlist, artists may commission a paid new editorial review for a possible one-month extension within 48 hours of removal. The offer is communicated by email and visible in the app under "Extensions".

8.2 The total price of €4.50 is charged solely for the new editorial review. No VAT is charged pursuant to § 19 UStG. An extension or specific placement duration is not part of the owed review service and is not guaranteed.

8.3 If the new editorial review is not completed within 48 hours, no extension will take place. Because the paid review service was not provided, the total price will be refunded to the original payment method.

8.4 The curator may decline an extension. Approval is not guaranteed.

8.5 The paid review service is completed once the new editorial review has been completed, irrespective of its outcome. Rejection alone therefore does not entitle the artist to a refund. Statutory withdrawal, warranty, and reimbursement rights remain unaffected.

8.6 The extension offer expires 48 hours after the song is removed. No retroactive extension is possible after this period.

§ 9 Prices and Payment Processing

All displayed prices are total prices in euros. No VAT is charged pursuant to § 19 of the German VAT Act (UStG). No delivery or shipping costs apply.

Payments are processed via Stripe, Inc. Playlist Jungle does not store credit card data. Stripe's terms of service (stripe.com/legal) apply in addition.

Stored payment methods can be changed or removed at any time via the platform's billing portal.

In the event of payment default or chargebacks, Playlist Jungle reserves the right to temporarily restrict access to paid features.

§ 10 Right of Withdrawal for Consumers

Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded.

To exercise your right of withdrawal, you must notify us (Paul Roggenbuck, Seesener Straße 73, 10709 Berlin, email: info@playlist-jungle.de) by means of a clear statement (e.g. by email) of your decision to withdraw.

The separate withdrawal policy at https://www.playlist-jungle.com/widerruf applies to consumers.

Consequences of withdrawal: If you withdraw, we will reimburse all payments received from you promptly and no later than fourteen days after receipt of your withdrawal notice. We will use the same payment method for the reimbursement as you used for the original transaction.

§ 11 Content and Intellectual Property

Artists retain all copyrights and other rights to their submitted songs. By submitting, you grant Playlist Jungle a non-exclusive, revocable licence required for the technical operation of the platform (processing, transmission to curators, display).

Artists warrant that they hold all necessary exploitation rights to submitted songs and that the submission does not infringe any third-party rights. Artists shall indemnify Playlist Jungle against any claims by third parties arising from a breach of this warranty.

Curators may not use, reproduce, or distribute submitted songs outside of the platform's features.

All rights to the platform itself (software, design, texts, trademarks, logos) belong to Playlist Jungle or its licensors. Any use beyond the intended purpose is not permitted.

§ 12 User Obligations and Prohibited Conduct

Users agree to use the platform only for its intended purpose and in compliance with these Terms and applicable law.

The following is expressly prohibited:

Suspected illegal content may be reported using the dedicated notice mechanism in support. Notices should identify the exact location, provide a reasoned explanation, and include available evidence. Receipt is acknowledged.

Playlist Jungle reviews notices diligently, promptly, objectively, and without arbitrariness. Affected users generally receive reasons for content removals or account restrictions and may challenge decisions through support. Challenges are decided after human review.

  • Submitting songs to which you do not hold sufficient rights;
  • Creating fake accounts or manipulating ratings or the feedback system;
  • Automated use of the platform (bots, scraping, automated submissions);
  • Circumventing technical security measures (rate limiting, bot detection, CAPTCHA);
  • Distributing spam, malware, or other harmful content;
  • Abusive, harassing, or offensive use of support or communication features;
  • Actions that impair the availability, integrity, or security of the platform.

§ 13 Spotify Integration

The automatic addition and removal of songs from Spotify playlists is performed via the official Spotify Web API. Playlist Jungle has no influence over changes, outages, or restrictions of the Spotify API.

Users who connect their Spotify accounts grant Playlist Jungle the OAuth access permissions required for platform features. These may be revoked at any time in Spotify account settings.

Spotify access tokens are stored in encrypted form. See the Privacy Policy for details.

Playlist Jungle is not responsible for Spotify service outages or changes, and is not liable for resulting delays in playlist management.

§ 14 Liability

14.1 Playlist Jungle is liable without limitation for damages arising from injury to life, body, or health, and for damages caused by intent or gross negligence.

14.2 For slightly negligent breaches of material contractual obligations (cardinal obligations), Playlist Jungle's liability is limited to the typically foreseeable damage at the time the contract was concluded.

14.3 Any further liability of Playlist Jungle for slightly negligent breaches is excluded.

14.4 Playlist Jungle accepts no liability for: curator decisions (acceptance or rejection of songs); actual placement duration of songs in Spotify playlists; Spotify API changes or outages; the artistic or commercial success of submitted songs; technical disruptions outside Playlist Jungle's control.

14.6 The above limitations do not apply where Playlist Jungle has fraudulently concealed a defect, given a guarantee, or where claims arise under the German Product Liability Act.

§ 15 Term and Termination

The usage agreement is concluded for an indefinite term.

Users may terminate their account at any time by contacting support or using the account deletion feature. Unused paid credits are generally non-refundable upon user-initiated termination, unless termination occurs within the withdrawal period (§ 10).

Playlist Jungle may terminate the usage agreement for cause without notice, in particular for serious or repeated violations of these Terms, suspected fraud or manipulation, or enforceable orders by authorities or courts.

If Playlist Jungle terminates an account for a reason not attributable to the user, unused paid credits will be refunded on a pro-rata basis.

§ 16 Changes to Terms and Service

Changes to these Terms will be communicated to users in text form with reasonable advance notice. Changes to material contractual content and any other changes requiring consent by law become effective only with the user's express consent.

If a user objects to a change requiring consent or does not provide the required consent, the previous Terms remain applicable. If continuation of the agreement is unreasonable for Playlist Jungle as a result, Playlist Jungle may terminate the agreement with ordinary notice; unused paid credits will then be refunded pro rata.

Technical and design changes must not unreasonably impair the agreed scope of service or statutory rights.

§ 17 Privacy

The collection, processing, and use of personal data is governed by the EU General Data Protection Regulation (GDPR) and other applicable data protection law.

§ 18 Final Provisions

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In relation to consumers resident in another EU member state, the mandatory consumer protection laws of that member state also apply.

The statutory places of jurisdiction apply.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should any provision of these Terms be invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory rule.
